These terms and conditions describe our policies and procedures on the collection and deliveries of products, use and disclosure of your information when you use the service and tells You about Your privacy rights and how the law protects You.

 

1. OVERVIEW:

www.dercarange.com (“the Website”) enables the purchase of Derca Products (“Products’”) online by the consumer.

The Website is owned and operated by the LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD, (hereinafter referred to as “Derca” or “we” or “us”).

All visitors to the Website (“Users” or “you”) will be able to see the products on offer, but only those who have registered for an account on the Website (“Derca account holders” or “you” or “buyer”) are able to purchase products online.

By registering and using the Website Users and Derca account holders, including those that buy from the Website, are bound by these Terms and Conditions and are deemed to have read and accepted these Terms and Conditions.

If you have accessed the Website from a specific link on a Derca Online Affiliate’s (Affiliate) website you will be bound by these terms and conditions and are deemed to have read and accepted these terms and conditions.

“Derca Online Affiliate” (“ Derca Accredited Affiliate” or “Affiliate”) is an authorised stockist of Derca that has met our Online Affiliate Program criteria.

1. MARKETING COMMUNICATIONS:

When you access or use the Website, sign up for a Derca newsletter, opt into marketing communication, register an account, conclude a purchase or transaction, or send an email to [email protected], you agree to receive electronic communication from Derca and you are able to unsubscribe at any given time.

1. USAGE OF WEBSITE:

When you access or use the Website, you confirm that this will not be done for any purpose that is unlawful or prohibited by the Terms and Conditions and any notice displayed on the Website.

Any unauthorised commercial use of the Website and its services, or the resale of its Products and services, is expressly prohibited.

You may not use the Website in violation of the South African laws and Regulations, and if you access the Website from locations outside of South Africa then the User is responsible for compliance to all local laws and regulations.

1. INTELLECTUAL PROPERTY & OWNERSHIP:

The contents of the Website, including any material, information, software, icons, text, graphics, layouts, images, sound clips, advertisements, video clips, trade names, logos, trademarks, designs, copyright and all other forms of intellectual property displayed on and/or incorporated in the Website (“Website Content”,), are protected by law, including but not limited to copyright and trademark law.

The Website Content is the property of LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD.

You will not acquire any right, title or interest in or to the Website or the Website Content.

Any use, distribution or reproduction of the Website Content is prohibited unless expressly authorised in terms of these Terms and Conditions, or otherwise provided for in law.

Where any of the Website Content has been licensed to LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD or belongs to any third party, your rights of use will also be subject to any terms and conditions which that licensor or third party imposes from time to time and you agree to comply with such third party terms and conditions.

1. PRODUCT AVAILABILITY, PROMOTIONAL ITEMS & PRODUCT CHANGES

All Products displayed on the Website are limited and are subject to availability.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will make all reasonable attempts to ensure that when the stock is no longer available the item, in particular, is discontinued on the Website.

If we are not able to fulfil any order because the stock item is sold out, we will inform you and you’ll be entitled to a reimbursement for the Rand value you have paid for such stock item.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD reserves the right to distribute promotional items solely on the Website.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD reserves the right to communicate product changes to you on the Website, this may include but is not limited to, the discontinuation of products, packaging changes, name changes and formula changes.

1. EXPIRY DATES OF PRODUCTS

Derca Derma Cosmetics products carry an expiry date. This date is clearly printed on both the outer carton and also on the Product container.

If you receive a Product, that has been purchased on the Website, that expires in less than 3 (three) months at the time of receipt then we will replace that Product free of charge.

In order to receive your replacement free of charge, you will need to do the following

Click ‘Contact us”, select ‘Return product’ and ‘I have received an expired product’ from the drop-down menu within 14 (fourteen) working days of receiving your order.

If such notification is not received within this time frame then LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD makes no guarantee or commitment with regard to replacing the Product.

1. PURCHASING PRODUCTS

The Website allows you, the User, to place electronic orders (“order”) for one or more products on offer as long as the products are available and are not sold out.

A sale agreement (“sale”) between you and LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will only come into effect when you have fully completed all of the following:

Fully completed AND submitted the online order form for one or more products in your basket (“shopping cart”).

Your payment has been authorised by LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD and/or has been received into  LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD bank account.

You are not able to reserve products to be bought at a later stage, and placing an item in your shopping cart or adding an item to a “Wishlist”, without fully completing the order does not amount to a sale or an order.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD may not be held responsible if an order has become unavailable by the time you try to complete a purchase at a later stage.

The invoice for your purchase will be available via email and a copy of this invoice will be included in your parcel.

Record keeping of transactions:

Complete records of each transaction between you and LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD are kept on record for 12 (twelve) months after a particular purchase or related transaction. After the 12 (twelve) month period the responsibility of keeping such record falls onto you.

When you purchase through an Affiliate’s Website, mixed baskets/orders/shopping carts are not permitted, this means that only  LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD products advertised on the Website may be purchased by the User.

1. CANCELLATION OF ORDERS

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD reserves the right to refuse the processing of payment for any order and/or to cancel any purchase, partially or completely, with notice given to you.

In such an instance we will be liable to reimburse you the Rand value paid only if you have already paid for the cancelled order and the payment has reflected in the LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD bank account after the deduction of a 10% administration charge.

You are entitled to cancel, either in part or in whole, any purchase without incurring any administration fees if your order has not already been sent out with one of our courier companies.

1. FRAUD

We reserve the right to remove any User from the Website should we suspect that the User is fraudulently and unlawfully distributing the goods purchased from the Website.

In such an instance LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will only be liable to refund money already paid by the User and will provide notice to the User.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD accepts no liability which may arise as a result of such blacklisting and/or refusal to process any order/sale.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD may request documentation to complete the necessary fraud checks and cancel any order where the necessary documentation is not provided in a timely manner. In the event of a fraudulent purchase being made on the Website, the cardholder is recommended to initiate a chargeback via their bank in order to be reimbursed.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will not process refunds for orders that are suspected of fraud.

1. PRICING OF PRODUCTS

The price of each product is displayed on the Product listing and if there is a special offer the promotional price will be displayed. All listed Product prices are subject to Value Added Tax of 15%.

We will take all reasonable efforts to accurately display prices and delivery charges. If, however, the Product is offered at an incorrect price (or an incorrect delivery cost is displayed), LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD is not obliged to supply products at the incorrect price/delivery fee.

We will only be liable to return payment already made by you should you not wish to continue with the purchase at the correct price and/or delivery charge.

If an Affiliate lists an incorrect product price on their Website, LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will not be obligated to honour this incorrectly listed price.

1. PAYMENT OPTIONS

We offer the following payment methods:

• Yoco® – For Credit Card payments – for local collections only
• PayFast – For Instant EFT or Credit Card payments
• Payflex – 25% upfront, then three payments of 25% over the following six weeks.

When you place an order, the transaction details will be presented to your bank for authorisation of the payment amount. If the authorisation is not obtained, the order will be cancelled.

If authorisation is obtained, payment is usually immediate.

Debit/ Credit Card Transactions will be completed and accepted when a original proof of payment is received or the funds is reflected in LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD bank account.

The payment gateway will use the strictest form of encryption and no credit card details will be stored on the Website. Your personal details will be stored separately from your credit card details.

The transaction currency is South African Rand (ZAR).

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD is in no way responsible for any loss incurred to the User from fraudulent transactions occurring on their account, arising from the User entering their credit card details on the Website.

1. DISCOUNT CODES AND GIFT VOUCHERS

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD may release printed or digital vouchers and/or promotion code and or coupon (“voucher”) from time to time that will allow you to be able to redeem against your online purchases.

These vouchers may be available through the Website and/ or from a third-party Website, in magazines and other media.

Vouchers may only be redeemed against your purchase on the Website as long as the vouchers are valid and specified expiry dates cannot be moved.

Vouchers must be used while they are valid, are not redeemable for cash and will not be replaced if the physical voucher is lost, stolen, destroyed or used without permission.

Vouchers are not transferable, cannot be exchanged for cash and cannot be used to purchase another voucher.

A voucher can only be used against a purchase once and the full amount of the voucher is required to be redeemed as any difference between the purchase transaction and the voucher will not be redeemed in cash.

The value of the voucher will be deducted from your total amount in your shopping cart and the remaining balance must be paid by you.

If you have redeemed a voucher against a purchase and you’d like to return all items purchased, we will refund you or credit your account with the Rand value of the purchase excluding the rand value of the voucher with a 10% administration fee.

If you have redeemed a voucher against a purchase and you would like to return only some of the items purchased, we will recalculate the total value of your purchase AFTER the returned item(s) has/have been deducted.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD also makes available on the Website electronic gift vouchers that may be purchased to be redeemed against purchases. Currently, this functionality is not available on the Website.

You are able to set the gift voucher value to any value between R100 and R10 000 and the chosen value may only be in Rands and no cents will be permitted.

You will be able to redeem only one one gift voucher against your purchase.

You will be able to check the balance of your gift voucher within your account on the Website.

You may purchase a gift voucher for use on the Website by yourself or as a gift for a third party. The gift voucher will be sent to you or your chosen recipient via email.

Gift vouchers are not refundable for cash once purchased and can only be redeemed against online purchase transactions on the Website.

The value of the gift voucher will be deducted from your total amount in your shopping cart and the remaining balance must be paid by you.

Vouchers are valid for a period of three years from the date of purchase. 

1. DELIVERY FEES

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD charges delivery fees based on the ZAR amount of the total purchase transaction (excluding VAT).

The delivery charge will be calculated and specified upon checkout of the relevant product or products ordered and will be calculated based on the available product information.

Delivery charges:

The purchase transaction is less than R700 with standard delivery times – R99.

The purchase transaction is greater than R700 with standard delivery times – free of charge.

Delivery charges quoted above are subject to petrol price changes and/or price increases and may be updated as and when required.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD at times will run promotions where delivery is free of charge. The relevant terms and conditions will be outlined in the Promotional Items section.

1. DELIVERY PROTOCOLS:

We deliver door to door or door and are sent to a street address. No PO Box deliveries will be permitted.

The User will need to indicate where in South Africa you require delivery, as well as contact numbers to be used in connection with the delivery. Your parcel will be delivered to the shipping address you specify at checkout.

If nobody is present at the address at the time of delivery, our courier will use the mobile phone number you provided in your order to indicate that a delivery was attempted.

The courier will try only once more (two attempted deliveries), and if at that time there is still no one to sign for the parcel, the parcel will be returned to our offices, and it will be your responsibility to rearrange delivery at your own expense.

If this attempt does not succeed within a reasonable amount of time, we will simply reimburse you subject to a deduction of the delivery fee and a 10% administration fee.

1. DELIVERY TIME AND DELAYS

Subject to stock availability and receipt of payment, orders will be processed within 2-3 working days and handed over to a courier company for delivery. No deliveries is mad on weekends and public holidays

Courier takes 3-4 working days, outlined areas can take up to 4-5 working days. Please note that if your parcel delivery falls over the weekend/public holidays then it may take longer.

We will supply all goods to the delivery company in good order and will ensure that the goods purchased are delivered to your chosen delivery address in the same order, should a parcel be damaged please see Damaged parcel policy.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will within reason ensure that delivery information supplied on the Website is accurate and where delays are incurred with deliveries every reasonable effort will be made to inform you.

We use the following couriers to deliver our orders:

• Fastway
• Cloud Logistics

 

 

1. LOST PARCELS

If neither the Warehouse nor the tracking system provides any indication where the parcel is, you need to get in contact with us and we will assist you in tracking your parcel with our third-party couriers. If the parcel is found, it will be sent to the specified delivery address.

If the parcel is declared lost, LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will notify the buyer and reimburse the buyer for the lost parcel (of the amount of the Product purchase price and any relevant delivery fee).

1. RETURNS, DAMAGED ITEMS AND REFUNDS

All complimentary products, gifts, and sample sachets are exempt from this clause.

Returns: We accept returns up to 7 days after delivery, if the item is unused and in its original condition, and we will refund the full order amount minus the shipping costs for the return. We will examine the condition of the goods being returned before making a refund or exchange.

Exchange: Should you want to exchange your products for something else. Shipping fees will be at your own charge. We will examine the condition of the goods being returned before making an exchange.

Damages: In the event that your order arrives damaged in any way, please email us withing 24 hours to let us know if the parcel and its contents is in anyway damaged or faulty. Please send an email with a detailed description of the damage and fault, your order number and pictures/video of the damaged or faulty product in question.

1. SECURITY

A User that attempts to deliver or delivers any damaging code to the Website or attempts to gain unauthorised access to any page on the Website will be prosecuted. LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will claim civil damages from the User if we suffers any damage or loss.

You agree that your login name and password will be used for your own personal use and will not be disclosed to any third party. You allow LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD to take any steps reasonably possible to ensure the integrity and security of the Website and in the administrative office.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD has no access to any confidential information regarding your payment method.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

However the User agrees to indemnify and hold LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD, its parent companies, subsidiaries, affiliates, officers and employees, and suppliers harmless from any claim, demand, or damage, including reasonable attorneys’ fees, asserted by any third party due to or arising out of the User’s use of or conduct on the Website and its services.

1. TERMINATION

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD is entitled to terminate these Terms and Conditions or close down the Website at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD and its Affiliates reserve the right to refuse service, termination of accounts, remove or edit content or cancel orders in their sole discretion.

1. MODIFICATIONS TO TERMS AND CONDITIONS

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD reserves the right to change these Terms and Conditions, or any part thereof, at its own discretion.

If you are an account holder, LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD will inform of the changes via email (the address you include in your registration). At this point, it will be your responsibility to ensure that you read through the revised Terms and Conditions and are satisfied with the updates. If you are not satisfied with any amendments to the Terms and Conditions, you have the right to terminate your account with LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD.

If you do not have a registered account with LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD, we will be unable to send you the amendments and if you enter into any transactions with LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD it will be deemed that you have accepted the amendments.

LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Service, or information provided to or gathered by us with respect to such use.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relate to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

The User and LA VAN BEAUTY SYSTEMS DERCA SA (PTY) LTD agree that any cause of action arising out of or related to the Website and its services must commence within 1 (one) year after the cause of action arose; otherwise, such cause of action is permanently barred.

The section titles in the terms of the Website and its services are solely used for the convenience of the parties and have no legal or contractual significance.
